Note: ¤ Deleya aesta (Baumann et al. 1972) Baumann et al. 1983, ¤ Alcaligenes aquamarinus (ZoBell and Upham 1944) Hendrie et al. 1974 (Approved Lists 1980) and ¤ Alcaligenes faecalis subsp. homari Austin et al. 1981 are members of a single species of the genus Deleya Baumann et al. 1983. Akagawa and Yamasato 1989 invoked Rules 23a and 51b of the Bacteriological Code (1976 Revision) and came to the conclusion that the oldest synonym within these three species was ¤ Alcaligenes aquamarinus, and, therefore, proposed that the combination ¤ Deleya aquamarina be created. With the recognition of ¤ Deleya aesta as a synonym of ¤ Deleya aquamarina, the type species of the genus Deleya must be changed to ¤ Deleya aquamarina.

Note: The interpretation presented by Akagawa and Yamasato (1989), is incorrect, since they did not take Rules 15 and 17 of the Bacteriological Code into consideration. These Rules override Rule 51b and mean that the type species of the genus Deleya Baumann et al. 1983 remains ¤ Deleya aesta (Baumann et al. 1972) Baumann et al. 1983, despite the fact that ¤ Alcaligenes aquamarinus (ZoBell and Upham 1944) Hendrie et al. 1974 is older. Thus, the proposal to adopt the combination ¤ Deleya aquamarina (ZoBell and Upham 1944) Akagawa and Yamasato 1989, as the type species of the genus Deleya is illegitimate because it contravenes two of the Rules of the Bacteriological Code. Firstly the proposal to change the type species of the genus Deleya contravenes Rule 15 and is, therefore illegitimate. In addition the combination ¤ Deleya aquamarina Akagawa and Yamasato 1989 is also illegitimate because the authors should have adopted the name ¤ Deleya aesta [Rule 51b (1)].

Note: Dobson and Franzmann 1996 propose to transfer ¤ Deleya aesta (Baumann et al. 1972) Baumann et al. 1983 (the type species of the genus Deleya) to the genus ¤ Halomonas as ¤ Halomonas aquamarina (ZoBell and Upham 1944) Dobson and Franzmann 1996, comb. nov. According to Rule 37a, bacteriologists adhering to this proposal must change the name Deleya to ¤ Halomonas.
